Terms of Service
These terms apply to your use of lightsoutaus.com (the "Store") and any purchase you make from Lights Out ("we", "us", "our"). By using the Store or placing an order, you agree to these terms. Please read them together with our Refund Policy, Shipping Policy and Privacy Policy.
1. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded or limited. Where these terms conflict with those rights, those rights prevail.
2. Using the Store
You must be at least 18, or have the permission of a parent or guardian, to place an order. You agree not to misuse the Store, interfere with its operation, or use it for any unlawful purpose.
3. Products
Our products are printed to order by our fulfilment partner. We make every effort to show products accurately, but colours may vary slightly between screens and the finished product, and garment measurements may vary within normal manufacturing tolerances. Sizing information is provided in our Size Guide.
4. Prices and payment
All prices are in Australian dollars (AUD). Shipping and any applicable taxes are shown at checkout. Payments are processed securely through Shopify and its payment providers; we do not store your full card details. We may change prices at any time, but changes will not affect orders already confirmed.
5. Orders
Your order is an offer to buy. A contract is formed when we confirm your order by email. We may decline or cancel an order, for example if a product is unavailable, a pricing error has occurred, or we suspect fraud. If we cancel an order you have paid for, we will refund you in full.
6. Cancellations and changes
Because products are made to order, production can start soon after you order. Contact us as soon as possible if you need to change or cancel. We will help if production has not started, but we cannot guarantee changes once it has.
7. Discount codes
Discount codes, including WELCOME10, are subject to their stated conditions, cannot be exchanged for cash, and may be withdrawn or changed at any time. Unless stated otherwise, only one code may be used per order.
8. Shipping, returns and refunds
Shipping is handled as set out in our Shipping Policy. Faulty, misprinted or damaged items are handled under our Refund Policy and the Australian Consumer Law.
9. Intellectual property
All content on the Store, including the Lights Out name, logos, designs, the line "Even when the lights are out, I'm still home.", SEE DIFFERENT, images and text, belongs to us or our licensors. You may not copy, reproduce or use it for commercial purposes without our written permission.
10. Limitation of liability
To the extent permitted by law, including the Australian Consumer Law, we are not liable for any indirect or consequential loss arising from your use of the Store or our products. Where our liability for failing to comply with a consumer guarantee can lawfully be limited, it is limited to replacing the goods, supplying equivalent goods, or paying the cost of replacing the goods.
11. Privacy
We handle your personal information in accordance with our Privacy Policy.
12. Third-party services
The Store runs on Shopify and uses third-party services such as payment providers, our fulfilment partner and carriers. Their own terms may also apply.
13. Changes to these terms
We may update these terms from time to time. The version published on the Store when you place an order applies to that order.
14. Governing law
These terms are governed by the laws in force in Australia. You and we submit to the non-exclusive jurisdiction of the Australian courts.
